Oregon Capitol Reaches First Deadline

A deep breath was taken by all the legislators, staff and lobbyists who work in the Oregon State Capitol.  Last week, the more important date–the first chamber deadline–passed.

With the exception of Revenue, Rules, and joint committees that are not subject to the deadline, any bill not voted out of committee by April 9th is officially dead. For the GoWest Credit Union Association bill tracker, that means we were able to take 42 “dead bills” off our tracking system.  With a record number of bills introduced during this session, it is nice to at least take off a few bills!  Our priority bills are all still on track and working their way through the Oregon legislature.

Data Privacy Updates – HB2008A

This bill was used for a “gut and stuff” during the remaining days of the House being able to consider the bill.  HB2008A makes updates to the Oregon Consumer Privacy Act that was negotiated in the 2023 legislative session.  This legislation maintains the exemption for financial institutions based on compliance with the Gramm Leach Bliley Act.

HB2008A, with the amendment, prohibits processing or profiling the consumer if the controller has actual knowledge or willfully disregards that the consumer is younger than 16 years of age. The amendment prohibits selling the data of a person the seller has actual knowledge or willfully disregards that the data is from a person younger than 16. the amendment prohibits the selling of data that accurately identifies, within a radius of 1750 feet, a consumer’s present or past location, or the present or past location of a devise that links to the consumer by means of technology. In 2023, the Legislative Assembly enacted Senate Bill 619, the Oregon Consumer Privacy Act, that provides new rights to consumers and responsibilities for persons or companies (“controllers”) who, in a calendar year, control or process the data of 100,000 or more consumers or devices that link to one or more consumers, or 25,000 consumers if more than 25 percent of their revenue is from selling personal data.

Update from the State Treasurer

The State Treasury wanted us to share information about the unclaimed property program, “Checks Without Claims.” According to the Treasurer’s office, “This year, individuals in every Oregon county will receive payments as part of this initiative, reinforcing Treasury’s commitment to reconnecting Oregonians with their unclaimed property. We want to ensure that Oregonians recognize this program as legitimate and keep an eye out for their incoming payments.”
