Wyoming DEQ Issues Proposed Rule on Irrevocable Letters of Credit Legislation

The Department of Environmental Quality (DEQ) has issued a notice of proposed rules to implement house bill 41 – Irrevocable letters of credit passed during the 2025 session.

House bill 41 was sponsored by Representative Martha Lawley at the request of Sunlight FCU who attempted to provide an irrevocable letter of credit, in lieu of bonding for non-coal mine operations, to DEQ on behalf of a member; however DEQ had to reject the letter due to lack of specific language allowing letters from credit unions.

The rules update existing rules to recognize letters of credit provided by credit unions. GoWest will review and provide comments on behalf of Wyoming’s credit unions and participate in the June 19, Land Quality Advisory board meeting.
